3 ways employers discriminate against younger workers | AntiHR The federal Age Discrimination in Employment Act (ADEA) forbids age discrimination against people who are age 40 or older. But, It does not protect workers under the age of 40 Because of this fact, many employers engage in discriminatory behavior towards younger workers, i.e. employees under the age of 40. Is this legal? Well, it depends. While the federal law does not protect employees under 40 i.e., younger workers, many states have laws that protect younger workers from age discrimination.
