Rose Acre Farms, Inc. | 434 N.E.2d 931 (1982) Mark Dove worked construction for Rose Acre Farms. He signed on to a bonus program that required perfect work attendance for ten weeks. During the tenth week, Dove got sick and missed two workdays. Was he still entitled to the bonus? The Court of Appeals of Indiana made that decision in Dove versus Rose Acre Farms. David Rust owned and operated Rose Acre Farms. Rust was strict about his employees’ tardiness and absenteeism, so he instituted a number of bonus programs to encourage timeliness and regular attendance. All the bonus programs were voluntary, and not all employees participated. The terms of every program were written on cards given to each employee participant. The only consistent condition in every bonus plan was the rule that the bonus would be forfeited if an employee missed a day of work for any reason or was tardy even for a minute during the bonus period. Rust strictly enforced this condition. Dove agreed to a bonus program requiring him to work on a particular construction project for ten weeks. He knew that he had to work at least five full days for ten weeks to qualify for the bonus payment. During the tenth week, Dove missed two workdays because he contracted strep throat. Rose Acre refused to pay him the bonus. Dove sued Rose Acre, seeking his bonus payment. The trial court ruled for Rose Acre. Dove appealed to the Court of Appeals of Indiana.
