GUERNSEY POLICE (UNLAWFUL) ENTRY Someone has reported “shouting” coming from the shared residential area where Mr X lives. Mr X’s residence’s is quiet as PC A knocks on the door. Mr X opens the door (whereupon no noise is heard). PC A places his hand over the boundary of the doorway and into Mr X’s residence (without permission or lawful right). PC A is politely asked to step back. He does not. Instead, he moves closer still and places his entire body in and over the boundary of the doorway and into Mr X’s residence (without permission or lawful right). Mr X politely asks him to step back two more times, but is ignored. Mr X, completely within his rights, then attempts to close the door. Officers explode into action. PC A even kicks at the door. Both PCs try to (unlawfully) force their way in. During which, PC A reaches for his PAVA incapacitant spray. Mr X, nervous and scared, opens the door. Officers quickly storm in despite having no legal right to do so. Mr X is forced back (or be assaulted) by PC A. Mr X reports that both PCs are aggressive and intimidating. Whilst shouting at him, Mr X sees PC B pop the lid off his PAVA spray. Officers refuse to leave, saying they are legally permitted to enter because of a “breach of the peace” (which cannot and does not apply in these circumstances). No charges were brought against Mr X. NOTE Placing limbs or their body over the threshold of your doorway is common tactic employed by police in order to gain (unlawful) entry into your house. If and when you attempt to close the door, no matter if it is your lawful right to do so, you will likely be accused of (and subsequently charged with) “obstruction” or “assault on police officer” (or similar).
