The Supreme Court has clarified an important legal principle: functional disability is different from permanent disability. While permanent disability is medically assessed, functional disability refers to how much a person’s earning capacity and profession are affected after an accident. In this case, Ayurvedic doctor Ashok Choubey suffered serious injuries after a car accident and underwent multiple surgeries over the years. • The Motor Accident Claims Tribunal fixed his disability at 5% and granted ₹17.6 lakh. • The Madhya Pradesh High Court raised it to 10% and awarded ₹22.9 lakh. • The Supreme Court, however, held that 10% was too low, considering the impact on his medical practice. The Court reassessed his functional disability at 30% and enhanced the compensation to ₹46.4 lakh with 6% interest.
