How to get someone out of jail before their trial date If a friend or a loved one has been arrested and is in jail awaiting trial, you may be wondering what to do to try to get them out of jail. Before trial everyone is presumed innocent. In most instances the law allows a person to be released prior to trial. Typically a person is released before trial by making some form of a bond. Some people call this a bail bond. The concept of bond is essentially that a person promises the judge that a someone who is accused of a crime and locked will show up for court. The judge basically does a legal version of telling the person “to put their money where their mouth is”. The judge will set amount of money which serves as legal assurance that the accused person will show up for court. If they fail, the person who put up the money or sometimes property can lose it. Unfortunately sometimes well-meaning friends and family members can lose a good deal of money or property if the accused person does not show up for court as they are supposed to. In Madison County, Alabama there are four methods by which an inmate can be released prior to their court date. The first is a “cash bond”. This is exactly what it sounds like; to get someone out of jail you would have to post whatever amount set by the judge - in cash. For example if the judge set bond at $500 cash, a person would need to post $500 cash for them to get out of jail. For cases with smaller bonds this is not a problem but when someone is accused of a serious crime and has a very high cash bond is often difficult if not impossible to get them out of jail. While people may be able to come up with $500 cash to get someone out of jail if the bond is $10,000 or $20,000 cash, most people your remain in jail unless they have some cash rich friends. Generally people are able to post cash bonds on less serious offenses simply but can’t afford the higher cash bonds that sometimes occur. Fortunately, if someone has a high bond, a lawyer can request the judge lower it by filing a Motion for bond reduction.Just bear in mind that the court system does not move very fast and the person in jail will remain in jail until bond is posted. If you are paying a lawyer to try to get the bond reduced, is it better to put the money towards the bond or the lawyer? That answer depends on how much the bond isn’t how much the lawyer is charging. In some instances it might be smarter to save the money you would pay a lawyer and use it towards the bond. Of course if bond is not posted, a person can languish in jail for a long time until their trial date. On serious cases it often takes a year or more for the case to come to court. The second type of bond is a property bond. A property bond is based on the tax assessment of property owned by the person or people who attempting to secure the release of somebody who is in jail. The third type of bond is when a person uses a bonding company. Essentially for a monetary fee the bonding company promises that a particular will show up for court. Most bonding companies charge about 10% of the amount of cash bond to get someone out of jail. In other words if somebody has a bond of $500 a friend or relative may pay a bonding company $50 and the bonding company promises the court that they will pay the $500 should the person fail to show up for court. The bonding company will keep the 10% as their fee and as long as a person shows up they would’ve made $50. The bonding company is betting the person will show up. If the person does not show up the bonding company can be out the $500. Of course that’s when they send someone like “Dog the Bounty Hunter” to get somebody because they don’t want to lose their money to the court system. The fourth way that people can get out of jail prior to their trial date is through pretrial release. This type of release is approved by the office of alternative sentencing hearing in Huntsville and they can allow someone to remain out until the time of their court date.
