Wednesday 2 – Thursday 3 October 2024 Before Lord Justice Underhill, Vice-President of the Court of Appeal, Civil Division Lord Justice Bean Lady Justice Falk By Appellant’s Notice filed on the 7 July 2023, the claimant (C) appeals the decision of the Employment Appeals Tribunal EAT) dated 16 June 2023. The EAT allowed C’s appeal on grounds 1 and 2 not on grounds 3-7. The judge rejected C’s submissions inviting her to substitute a decision to allow her claim or to order a retrial before a differently constituted ET. The judge instead remitted the case to the same ET for determination based on the existing findings and without any new evidence. The background is that C worked as pastoral administrator in R’s secondary school. After complaints were received relating to Facebook posts which C had made concerning relationships education in primary schools, C was suspended and after a disciplinary investigation dismissed.
