What role does international human rights law play in shaping climate change obligations of states and companies? Scholars, UN human rights entities and mechanisms, civil society organisations and climate activists have long argued that human rights law not only matters but also offers powerful tools to address climate change. In a space of a few weeks, the Inter-American Court of Human Rights and the International Court of Justice have provided an authoritative elaboration of how international human rights law interacts with international climate law. The landmark advisory opinions of these two courts are likely to have far-reaching implications for states and companies in all world regions.
