Attorney Scrofano goes through the brief history of the dysfunctional DC cannabis laws and what lead to the rise of the so-called grey market gifting dispensaries and delivery services. A combination of Congressional interreference in DC Home Rule along with MPD inconsistent and arbitrary enforcement of cannabis distribution laws has lead to a highly irregular legal/illegal cannabis distribution market. Attorney Scrofano further discusses what the potential short-term future of the DC cannabis market may look like now that the "Harris Rider" has not been lifted even with Democrats controlling both Houses of Congress and the Presidency. Chairman Mendelson's bill would have imposed steep fines on unlicensed cannabis distributors and had punitive provisions for landlords who let these businesses operate in their properties. The bill failed so the situation remains unchanged. While no one can truly predict what will happen next, one possibility is the Council passing a bill to increase the number of licenses for medical marijuana dispensaries and permitting residents to "self-certify" that they have a qualifying medical conditions to get a medical cannabis card.
