Alabama Felony Murder Ala. Code 1975, § 13A-6-2(a)(3) is being misused and abused, because the death was not caused by LaKeith or any of the participants. The law clearly states that if person commits the appropriate felony; and, in the course of and in furtherance of the crime that he/she is committing or attempting to commit, or in immediate flight therefrom, he/she, or another participant if there be any, causes the death of any person. The police who killed A’Donte Washington are not participants in the crime and based on the definition of Alabama Felony Murder, LaKeith should not be charged for such. The father of A’Donte, Andre Washington told the court, “LaKeith should be home”. LaKeith Smith has spent over 8 years with good standing and no issues while one of the youngest in maximum security prisons with societies most violent and dangerous individuals.
