Prohibition Notices are issued when homes are deemed unsafe to live in, forcing residents to leave - sometimes within days, sometimes within hours. In November 2020, this happened at Victory Apartments in Oldham, where serious fire safety issues were identified, including faulty fire doors, inadequate compartmentation and poor ventilation. Rip Off Britain spoke to Fozia Malik and Lee Ashworth, two Victory Apartments leaseholders, to hear about the emotional and financial impact they’ve endured while waiting for the freeholder and managing agent to undertake the work needed to lift the prohibition notice. Throughout that time, Victory’s leaseholders have been forced into paying thousands of pounds in service charges – much of which has been for “services” that we have been told were not provided. Alongside those costs, Fozia has had to pay a mortgage for the flat and rent for alternative accommodation. Lee and his wife Susan, pensioners relying on the flat for income in their old age, have lost tens of thousands of pounds. Whilst it is good news that the building is now able to be occupied, we understand the fire safety works required to lift the prohibition notice were relatively straightforward and should not have taken five years. It is worth noting that the major cladding remediation works at Victory Apartments are yet to start. We also note the Building Safety Act 2022 should ensure “qualifying leaseholders”, such as Fozia and Lee, are protected from cladding and non-cladding costs in law as their flats are assessed as being “low value”.
