In 1925 the State of Tennessee passed the Butler Act which outlawed the teaching in public schools of “any theory that denies the story of Divine Creation of man as taught in the Bible.” The American Civil Liberties Union, sensing a possible violation of the First Amendment, advertised in Tennessee newspapers an offer to assist in the defense of anyone charged with violating that law. A group of civic leaders in the small town of Dayton, Tennessee, saw the ad and recognized an opportunity. The result was State of Tennessee vs. John T. Scopes, which became one of the most celebrated, debated, and misunderstood jury trials in American history. The case began as a simple misdemeanor prosecution. It concluded as an emotional and spectacular clash between two towering giants of American law: William Jennings Bryan for the prosecution and Clarence Darrow for the defense. The issues in that trial continue to polarize, divide and even confuse many Americans. And the Great Monkey Trial, as it came to be known, has entered the world of myth, with Americans holding many misconceptions and mistaken beliefs about what happened in that sweltering rural Tennessee courthouse in the long, hot summer of 1925. Hal Johnston is a 1982 graduate of the McKinney School of Law and spent most of his legal career as a prosecuting attorney for the State of Indiana. He is a veteran of scores of Indiana jury trials ranging from multiple murder cases to misdemeanors. He also holds a degree in History from Indiana University and has had a life-long interest in the Scopes case. Hal has taken his experience as a trial attorney and his training in history to dissect the Scopes trial and explain the case from the unique perspective of a trial lawyer.
