That’s the question in Kennedy versus Bremerton School District. Joseph Kennedy coached football for the Bremerton School District. Kennedy regularly knelt at midfield on the high school football field to pray after each game. Initially, Kennedy prayed alone. Over time, students began to join him. Ultimately, most of the team joined in. When Kennedy prayed, students and fans were still in the stands after the game. Other school employees would speak with friends and family, check their phones, and carry out other personal business. When Bremerton learned about Kennedy’s prayers, Bremerton instructed Kennedy to refrain from engaging in any overt actions that appeared to endorse prayer while on duty. Kennedy continued to kneel and pray following the next three games. Each time, Bremerton’s players were busy elsewhere singing the school fight song, although community members and opposing players joined Kennedy. Bremerton suspended Kennedy, then declined to rehire him for the next year. Bremerton cited Kennedy’s failure to follow district policy regarding religious expression and to supervise student-athletes after games. Kennedy sued Bremerton in federal court, alleging that Bremerton violated his First Amendment rights. The district court granted summary judgment for Bremerton. The Ninth Circuit affirmed.
