The court ruled that child maintenance and upbringing are the legal, moral, and social responsibilities of both parents. A higher income of the mother does not exempt the father from his duty to financially support and care for his children. The bench led by Justice Swarana Kanta Sharma observed that when a working mother earns more and also takes care of the children, it means she is bearing a double burden. In such cases, a father cannot make excuses to avoid his responsibilities. This judgment came while rejecting a man’s plea challenging an order to pay ₹30,000 per month as interim maintenance for his three children. The husband argued that his income was ₹9,000 while his wife earned ₹34,500. However, the High Court upheld the lower court’s order and dismissed his petition.
