Reserved matlab safe nahi hota. Kabhi-kabhi matlab indefinite wait. Legal Backbone In Anil Rai v. State of Bihar (2001), AIR 2001 SUPREME COURT 3173 Supreme Court of India observed: 👉 Judgment should normally be pronounced within reasonable time. 👉 If judgment is not delivered within 3 months, party can move representation. 👉 If still not delivered, matter may be placed before Chief Justice. 1️⃣ Delay Violates Article 21 The Court clearly held that: Inordinate delay in pronouncing judgment can infringe the right to personal liberty under Article 21. No justification after arguments over Important Practical Disclaimer These guidelines mainly apply to High Courts. • Subordinate courts ke liye supervisory power High Court ke paas hoti hai. • Use respectfully, not aggressively. PRACTICAL SOLUTIONS Step 1 – Mentioning Before Court Politely say: “Your Honour, matter was reserved on ___ date. Kindly clarify regarding pronouncement.” No aggression. No accusation. Step 2 – Written Representation File a simple application: “It is respectfully submitted that arguments were heard on __ and matter was reserved. Kindly be pleased to pronounce judgment.” Keep it short. No emotional drama. Step 3 – Representation to District Judge / Chief Justice If delay exceeds reasonable time. As per Anil Rai judgment, representation is legally permissible. Step 4 – Article 227 Petition If: • 1 year delay • Serious prejudice • No response to representation High Court supervisory jurisdiction. But use carefully. Never as ego battle.
