Police Report (Summary) Date: February 28, 2023 Incident: BOLO for White Nissan Pick-Up Truck with No License Plate Location: Interstate 95 (State Road 9), MM 280, Volusia County, Florida Description of Incident: On February 28, 2023, Florida Highway Patrol Trooper Hudgen was dispatched to a BOLO regarding a white Nissan Pick-Up truck with no license plate reported on Interstate 95 (State Road 9) at mile marker 280. Details of the Pursuit: As FHP Trooper Hudgen entered Interstate 95 (State Road 9) southbound at mile marker 260, he observed a white Nissan Pick-Up truck matching the BOLO description, weaving in and out of traffic at a high rate of speed. Trooper Hudgen immediately activated his emergency lights and attempted to initiate a traffic stop on the vehicle. Assistance from FHP Trooper Strack: Florida Highway Patrol Trooper Strack positioned further down the highway at approximately mile marker 257. He followed behind Trooper Hudgen, providing dispatch with updated location and speed information, as well as traffic conditions. High-Speed Chase: The suspect's vehicle continued southbound on Interstate 95 (State Road 9) at speeds of 117 MPH, dangerously swerving across all southbound lanes. Intervention by other Law Enforcement Officers: Numerous law enforcement officers attempted to use stop sticks to immobilize the vehicle. The driver of the white Nissan Pick-Up truck drove towards an Edgewater Police officer, forcing the officer to take evasive action to avoid being hit. Successful Use of Stop Sticks: Around mile marker 245, stop sticks were successfully deployed, puncturing the suspect's vehicle tires. As a result, the vehicle began to slow down and veered towards the right shoulder of Interstate 95. FHP Troopers and Volusia Sheriff Michael Chitwood positioned their vehicles around the suspect's vehicle. Arrest of Suspect: Trooper Strack and other law enforcement officers immediately detained the driver, identified as Seth Potter. During the arrest, Mr. Potter did not provide a middle name, date of birth, or social security number. Stolen Vehicle and Firearm: At approximately 6:01 PM, a delayed hit through NCIC/FCIC confirmed that the vehicle was reported stolen by the Jacksonville Sheriff's Office (case number 23-123798) on the same day of the incident. A firearm was also found in the vehicle, adding to the severity of the charges against the suspect. Vehicle and License Plate Identification: Upon further investigation, the vehicle's VIN was identified and checked against the NCIC/FCIC database. A license plate with Florida Tag was discovered inside the vehicle, matching the vehicle's VIN. Reading of Miranda Rights: Mr. Potter was formally arrested at 5:38 PM and was read his Miranda rights. Processing and Booking: Subsequently, Mr. Potter was transported to the Deland FHP Station, where arrest paperwork was completed. Later, he was booked into the Volusia County Jail.
