Bilkis Bano was a survivor of a brutal gang rape and the murder of her family during the 2002 Gujarat riots. Her prolonged legal battle, fraught with obstacles, became a defining case of the communal violence and a symbol of the struggle for justice. The attack during the 2002 Gujarat riots The incident: In March 2002, as anti-Muslim violence spread through Gujarat following the Godhra train burning, a pregnant Bilkis Bano, along with her family, fled her village. A mob attack: They were ambushed by a mob of 20–30 men in the Chhaparvad district. The attackers raped Bano and other women, and murdered 14 of her family members, including her three-year-old daughter. Survival and struggle for justice: Bano survived, pretending to be dead after losing consciousness. Following the attack, she faced multiple challenges, including botched investigations, police intimidation, and death threats, which delayed her fight for justice. The legal and judicial process Investigation transferred: The case was transferred out of Gujarat to Maharashtra by the Supreme Court of India in 2004, due to concerns that witnesses were being intimidated and evidence was being manipulated. Conviction: After the transfer, the Central Bureau of Investigation (CBI) took over the case. In 2008, a Mumbai trial court convicted 11 men of gang rape and murder, sentencing them to life in prison. Appeals upheld: The Bombay High Court and the Supreme Court later upheld the life sentences for the 11 convicts. Controversial remission and Supreme Court intervention Premature release: In August 2022, on India's Independence Day, the Gujarat state government granted remission to all 11 convicts, ordering their release. Their release was celebrated with sweets and garlands by supporters, which provoked widespread public outrage. Supreme Court challenge: Bilkis Bano, among other petitioners, challenged the early release in the Supreme Court. Remission quashed: In January 2024, the Supreme Court nullified the Gujarat government's remission order. The court found that Gujarat was not the appropriate authority to decide on the remission, as the trial had taken place in Maharashtra. The court ordered the 11 convicts to return to jail within two weeks. Court's remarks: The Supreme Court reprimanded the Gujarat government for "usurping the power" and noted that a previous order allowing Gujarat to consider remission was obtained by "concealment of facts" and "fraud" upon the court.
