Oregon lawmakers unanimously approved legislation to close a gap in Oregon's sex abuse law - uncovered in a KATU Investigation after a Clackamas County grand jury failed to indict a doctor accused of sexually abusing more than 100 of his patients. Senate Bill 974 makes it a crime for doctors to lie to their patients and sexually abuse them under the guise of medical care. Previously, some prosecutors ceded to an exception in the state's sex abuse law for medical care. Clackamas County DA John Wentworth cited that exception in a KATU Investigation into the Farley case and the lack of charges from the grand jury. That decision came despite sexual assault accusations from more than 100 former patients that led the Oregon Medical Board to take the exceedingly rare step to revoke his license. "Senate Bill 974 is specifically tailored to hold healthcare professionals accountable for exploiting the inherent power and trust differential between a doctor and a patient," Rep. Lisa Reynolds said shortly before the pill passed. Though Reynolds said police and prosecutors had a "somewhat laissez faire" approach in their investigation of Farley and provided "tremendous benefit of the doubt" to him, she said it was nonetheless necessary to close the loophole. "While we can’t predict what would’ve been the outcome on this specific case described if the bill had been law at the time, the case shines a light on the gap in Oregon’s criminal code, and Senate Bill 974 helps close that gap," Reynolds said on the house floor.
