Jonathan Joseph, Head of Solutions at Ketch, talks about what you should know about CCPA and CPRA. Here’s what you should know about the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA): 1./ Scope and Applicability: CCPA applies to businesses that meet certain thresholds, like earning over $25M in revenue or processing data of 100,000+ California residents. CPRA, an update to CCPA, took effect in 2023, strengthening consumer rights and adding new requirements for businesses. 2./ Key Consumer Rights Access: Consumers can request the personal information a business has collected about them. Deletion: They can request that their data be deleted. Opt-Out: Users can opt out of the sale or sharing of their personal data. Correction (CPRA): Consumers can request corrections to their personal data. 3./ Limit Use of Sensitive Data (CPRA): Users can restrict the use of sensitive information, like health or financial data. 4./ Transparency Requirements Businesses must clearly disclose their data collection, sharing, and selling practices in a privacy policy. 5./ A "Do Not Sell or Share My Information" link must be provided for easy opt-out access. 6./Expanded Definition of Sensitive Data (CPRA) CPRA adds protections for sensitive data, including race, religion, biometrics, health, and financial information. 7./ Data Minimization and Retention Businesses must collect and retain only necessary data for specific purposes. 8./ Data Protection and Vendor Management Companies must ensure third-party vendors comply with privacy requirements, including contractually limiting how they use shared data. 9./ Enforcement and Penalties: The California Privacy Protection Agency (CPPA) oversees enforcement. Fines: $2,500 per violation and $7,500 for intentional violations or those involving minors' data. 10./ Tips for Compliance: Update your privacy policy to reflect CCPA/CPRA requirements. Provide tools for users to exercise their rights. Implement robust data security measures. Train employees on compliance obligations. Staying proactive ensures compliance and builds trust with your customers.
