When starting a business in California, you can choose to form a Limited Liability Company (LLC). LLCs offer the benefit of limited personal liability protection and the ability to choose how to be taxed. There are 4 tax classifications for an LLC: Sole Proprietorship, Partnership, S Corporation, and C Corporation. The default tax classification for a single-member LLC is Sole Proprietorship, where the business income is reported on the owner's personal tax return. The default tax classification for a multi-member LLC is Partnership, where the business income is divided among the owners and reported on their individual tax returns. An LLC can also choose to be taxed as an S Corporation by filing an election with the IRS. This allows the business to avoid double taxation and provides the owners with the benefits of a corporation.
