Under the Fourth Amendment, an officer must be able to point to specific and articulable facts suggesting that a crime has been committed, is being committed, or is about to be committed before they can lawfully detain a person. Without that reasonable suspicion, any encounter with police is supposed to remain voluntary. In California, an officer does not need to activate their emergency lights for a detention to be considered lawful. The real legal question is whether a reasonable person in that situation would feel free to leave. Under the standard established in Terry v. Ohio, police must have reasonable suspicion that a crime has been committed, is being committed, or is about to be committed in order to detain someone. Emergency lights can signal that a stop is occurring, but they are not legally required—what ultimately determines whether an encounter is consensual or a detention is the officer’s actions and whether their show of authority would make a reasonable person believe they are not free to walk away. An officer starting a conversation by saying “are you okay?” Doesn’t insinuate that the interaction is non consensual or that the person in question is being detained. And allegedly that is how this interaction began moments before Matt started recording. What transpired throughout the interaction has more to do with the ego of the officer rather than the infraction taken place.
