Supp. 532 (1986) Under Rule Nine B of the Federal Rules of Civil Procedure, or F R C P, a party, when alleging fraud or mistake, must plead circumstances constituting the fraud or mistake with particularity. But what if there are multiple defendants in the action? Must a plaintiff allege with specificity fraud and other claims against each defendant separately? This was the question for the United States District Court for the Southern District of New York in Bower versus Weisman. In nineteen eighty-five, Sachiko Bower brought an action in New York State court against Frederick Weisman and two corporate entities for breach of a written agreement. Specifically, Bower asserted Weisman agreed to five things. First, to purchase a house in California for her. Second, to provide Bower and her daughter with a trust. Third, to pay Bower an annual sum for ten years. Fourth, to pay for Bower’s living expenses until her remarriage or departure from the United States. And fifth, to provide possession of Weisman’s penthouse rent-free until her marriage or departure from the United States. In her complaint, Bower alleged numerous claims arising from breach of the agreement against both Weisman and the corporate entities. These included claims for fraud and misrepresentation. In response, Weisman moved to remove the case to federal district court, which the court granted. Weisman then moved for, among other things, a more definitive statement under Rule Twelve E of the F R C P, to dismiss Bower’s fraud claims under Rule Nine B of the F R C P, and to dismiss other claims for failure to state a claim under Rule Twelve B Six of the F R C P Want more details on this case?
