What is selective enforcement and how do you prove you are being targeted? The HOA Board usually tries to keep owners and residents in the community from open communication, so proving you are being targeted may be an impossible task. However, if you can prove the Board is in violation of the governing documents, yet enforcing fines on you, that is "selective" enforcement. No one should be above the law, yet Board members are held harmless for their actions. How can this be constitutional? Is the government above the law and held harmless? Why would our legislators allow a Board to be above the governing documents, we as owners agreed to? Shouldn't a member have a way to make a complaint to a government authority or the association attorney when they can prove a board is in violation? How do we as members protect the Association, if the rogue board is not in jeopardy of any consequences and no authority will hold the board to their duties? No one should be above the law...Remember those words. Protect your "guaranteed" rights.
