On May 3, 2024, around 5:53 PM, Officer Charles Keenan with the Elmwood Park Police Department responded to a motor vehicle accident near Mola Boulevard and Lincoln Avenue. Upon arriving, he noticed a male who was trapped inside a vehicle and reassured him that help was on the way. Officer Keenan then inspected the damaged vehicles, including a black Honda Accord located about 500 feet north of Godwin Avenue. Witnesses directed his attention to the driver of the Honda Accord, who was identified as 29-year-old Jean Lizardo. As Officer Keenan conversed with Jean, he noticed the smell of alcohol and other signs of impairment. Witnesses also indicated that the driver might be under the influence. Given the circumstances of the multi-vehicle accident, Officer Keenan asked Jean to perform field sobriety tests, which he willingly accepted. The testing began with the Horizontal Gaze Nystagmus (HGN) test, during which Officer Keenan observed some signs of impairment. Next came the Walk and Turn test, where Jean struggled to keep his steps in line and had difficulty turning. The final exercise was the One Leg Stand test, but Officer Keenan chose to end this test early for safety reasons, as Jean was unable to complete it. Taking into account the motor vehicle accident involving eight vehicles, the witness accounts, the alcohol odor, and Jean's performance on the field tests, Officer Keenan placed him under arrest for driving while intoxicated. Officer Hanz Brady transported Jean to the Elmwood Park Police Department for further processing. Some individuals from the accident were also taken to the hospital for their injuries. At the police station, further checks were conducted, and Jean was placed in a cell. After an initial inquiry about the accident, Officer Wendy Tinio read him the Standard Statement for Motor Vehicle Operators, which he agreed to. Officer Michael Mulligan operated the Alcotest machine, and the results revealed a BAC of 0.16%, exceeding the legal limit of 0.08%. After processing, he was released to a sober adult, who signed the Potential Liability Warning form on his behalf.
