The County Commissioners appointed by the then President Mwai Kibaki should vacate office as the process of putting them in office was neither transparent nor representative of gender and regional balance. This is according to the commission on administrative justice otherwise referred to as "office of the ombudsman". Through its chairperson Otiende Amollo the commission, whose part of its mandate is to provide advisory opinions on proposals on improvement of public administration, argues that the process of hiring the commissioners should be done afresh this time through the public service commission.
