Circuit Judge Scott Ellington sentenced 50-year-old Timmy Lynn Davis of Lake City to 480 months in the Arkansas Department of Corrections for theft by receiving, greater than or equal to $25,000, as well as 180 months in ADC for fleeing in vehicle or conveyance with substantial danger of causing death. The judge also sentenced him to 72 months of suspended imposition sentence on the following charges: First-degree criminal mischief First-degree criminal mischief, greater than $5,000 but less than $25,000 Two counts of aggravated assault Two counts of theft of property, greater than $1,000 but less than or equal to $5,000 Two counts of failure to stop after accident with property damage greater or equal to $10,000 Prosecutors also demanded at least $85,805 in total restitution due to the destruction caused by Davis. More could be added on later. The following charges were nolle prossed: Aggravated robbery Possession of firearms by certain persons Reckless driving Fleeing on foot Driving while license is cancelled, suspended, or revoked Improper use of registration According to a news release from Arkansas State Police, an ASP trooper attempted to stop a black GMC Yukon for displaying improper vehicle registration. The driver of the Yukon was identified as Davis, who failed to yield and attempted to flee. ASP said during the chase, Davis crossed the median of I-555, drove through a security fence at Nestle Prepared Foods, and abandoned his vehicle before stealing a truck with a trailer at gunpoint, resulting in the chase starting again. ASP and Jonesboro Police officers continued to chase Davis across Jonesboro until he crashed into a water-filled ditch near Windover Road. During the chase, ASP said Davis intentionally collided with pursuing officers at high rates of speed before he lost control of the vehicle near the Harrisburg Road exit and took off. The Jonesboro Police Department went to Nestle Prepared Foods and took a report on the vehicle theft. It was determined at that time, the black Yukon Davis was originally in, was also stolen from Jackson County, AR. Portions of the ASP incident report: On May 9, 2023, at approximately 3:23 PM, I was patrolling Interstate 555 near the 37-mile-marker southbound when I observed a black GMC Yukon bearing Arkansas license plate 755LLK. That plate returned to a black Ford F150 that expired in 2010. I activated my emergency lights to initiate a traffic stop. The operator of the Yukon pulled to the shoulder, accelerated, and began fleeing. I attempted to perform a Tactical Vehicle Intervention (TVI) twice, but the subject slammed on his brakes to avoid the TVI. The suspect drove through a yard prior to me catching up to him. I continued south on Heath Lane. TFC. Tanner Middlecoff turned on Heath Lane and located the black Yukon turning off Heath Circle onto Heath Lane. TFC. Middlecoff performed a TVI on the fleeing vehicle causing damage to the rear passenger tire. The fleeing vehicle continued north on Heath Lane and turned east on East Highland Drive. The suspect continued down East Highland before intentionally leaving the roadway at the Nestle Prepared Food Plant and traveling through a chain-link fence. After entering the plant, the suspect and his female passenger stole a 1999 Ford F350 and utility trailer at gunpoint. After stealing the truck and trailer, the suspect left the plant and continued south on Nestle Way. CPL. Logan Hall located the Ford F350 and re-initiated the pursuit. While on State Highway 463, the suspect rammed TFC. Tommy Fitzgerald's patrol vehicle. TFC. Fitzgerald performed a TVI but was unsuccessful. I passed Cpl. Hall and TFC. Fitzgerald and performed another TVI. After the TVI, I began fishtailing and left the highway to the right and entered a ditch. I was able to put my patrol vehicle in reverse and get out of the ditch. After I caught back up to the pursuit, a Jonesboro Police Officer attempted to spike the fleeing vehicle but was unsuccessful. At the intersection of Harrisburg Road and Highland Drive, the trailer being hauled by the fleeing vehicle hit another motorist causing damage. At the intersection of Southwest Drive and Highland Drive, the suspect turned left and began skidding causing the trailer to strike a traffic signal. I performed another TVI. After the TVI, the suspect vehicle continued until leaving the roadway to the left and crossing all four lanes of Interstate 555, and crashing the vehicle into a water-filled ditch behind the Windover Heights Subdivision. After the crash, the driver fled on foot into the residential neighborhood. A perimeter was set by Troopers, Jonesboro Police Officers, and Craighead County Deputies. The suspect was apprehended a short time later in the backyard of a residence.
