This is the deposition of Jeffrey Kelly, a Kern County deputy involved in the wrongful death case of David Silva, which resulted in a $3.4 million settlement. Case Summary On May 7, 2013, at approximately 11:00 p.m., David Silva was found unconscious near Kern Medical Center in Bakersfield, California. Deputy Kelly performed a "knuckle rub", causing Silva to stir, after which officers allegedly beat him with batons, used a police dog, and restrained him in a hogtie position with a "spit sock" over his head. Multiple eyewitnesses captured the incident on cell phone and surveillance footage, and Silva was heard calling for help before he died on the scene. Police allegedly seized the recorded evidence. Legal Action & Settlement On July 8, 2013, Tara Garlick (Silva's girlfriend and mother of his children) and other plaintiffs filed a civil rights wrongful death lawsuit under 42 U.S.C. Section 1983 in the U.S. District Court for the Eastern District of California. Plaintiffs argued that Silva died due to excessive force, while defendants claimed he died from heart issues and drug intoxication.
