Bail refers to the amount of money a defendant must "post" in order to be released from custody until their trial or final resolution of the case. Bail is not a fine and in theory, it not to be used as a form of punishment (in theory - although I have witnessed many Judges use it as punishment!). The purpose of bail is simply to ensure that defendants will appear for trial and all pretrial hearings during the pendency of a criminal case. The judge decides the amount of bail by weighing many factors: -the risk of the defendant not appearing -the type of crime alleged -the danger to the community -the seriousness of the offense -prior criminal history of the defendant -the defendant's history of appearing (or failing to appear) in court. A judge may release defendants on their own personal recognizance, often called "PR" (without a payment of money), on the promise that they will appear for all hearings and for trial. This is usually done if defendants have a long term employment, have established roots in the community, or limited criminal history. There are two types of bail, cash and bondable. Cash bail must be paid in full while bondable bail can be posted by a bail bondsman after the defendant (or family or friends) post 10%. These options are discussed in the video.
