A. UN Charter Provisions The UN Charter, signed in 1945, is the first international treaty to recognize human rights as a matter of global concern. While its references are often general, they provide the legal mandate for all subsequent UN human rights activities. Preamble: Reaffirms faith in "fundamental human rights, in the dignity and worth of the human person, [and] in the equal rights of men and women". Article 1: Establishes the achievement of international cooperation in "promoting and encouraging respect for human rights" as a primary purpose of the UN. Article 8: Mandates no restrictions on the eligibility of men and women to participate equally in UN organs. Article 13: Authorizes the General Assembly to initiate studies and make recommendations to assist in the realization of human rights. Articles 55 & 56: Form the "human rights backbone" of the Charter. Article 55 pledges the UN to promote universal respect for human rights, while Article 56 obligates member states to take "joint and separate action" to achieve these purposes. Article 62 & 68: Empower the Economic and Social Council (ECOSOC) to make recommendations on human rights and mandate the creation of a commission for their promotion (which led to the Commission on Human Rights, now the Human Rights Council). and B. International Protection of Human Rights The UN employs a multi-layered framework of legal instruments and monitoring bodies to protect human rights. The International Bill of Human Rights: Consists of the 1948 Universal Declaration of Human Rights (UDHR) and two binding covenants (ICCPR and ICESCR). Charter-Based Bodies: The 47-member Human Rights Council (HRC) reviews human rights situations globally through the Universal Periodic Review (UPR), supported by independent Special Procedures (Special Rapporteurs). Treaty-Based Bodies: Ten committees of experts monitor state compliance with specific, ratified human rights treaties. Office of the High Commissioner for Human Rights (OHCHR): Coordinates UN human rights activities, offering technical assistance and monitoring on the ground. Security Council: Addresses gross human rights violations in conflict zones.
