Comments? Transcript Benson Varghese: What should you do if you're involved in an accident with a person you believe may be intoxicated? Accidents involving intoxicated drivers are different than regular accidents. First and foremost, after you've checked to make sure you're not injured, call the police. The police need to be involved in any accident involving an intoxicated driver. The police will come out and they'll do an investigation. They'll typically do field sobriety tests, get some statements from the other driver, and if appropriate, arrest the other driver for driving while intoxicated. There are even higher charges for intoxication assault, if someone has a serious bodily injury. Or God forbid someone was killed, that would be an intoxication manslaughter case. So those criminal cases are going to run concurrent to any civil case that you may file. As with any personal injury case, it's important to seek an attorney, after you've sought medical attention, and talk to that attorney and your medical provider about continued treatment. You want to make sure you're getting the attention and the treatment that you need in that situation. Also, remember that injuries may not always be apparent when the accident happens. Adrenaline is rushing, and sometimes injuries themselves just take time to show up. So, it's important in a case like this to seek medical attention and then follow your doctor's advice. Typically, when there's an accident, we recommend that our clients take pictures of vehicles, of the location, maybe even shoot a video of what they're seeing. That's even more important in a case where you believe the other driver is intoxicated. If there are behaviors that you're seeing that lead you to believe that person might be intoxicated, you can absolutely take a video of what you're seeing.
