Webb Development Co. | 494 P.2d 700 (1972) Cattle farmers who set up shop in Maricopa County in the early 1900s had no idea that that Phoenix, Arizona, would one day become one of the largest cities in the United States. They certainly didn’t expect retirees to move in next door. Cows locked horns with real estate development in the case Spur Industries Incorporated versus Del E. Webb Development Company. In 1956, Spur Industries’s predecessor started building cattle feedlots in an area about 15 miles from the urban center of Phoenix. By 1959, it was feeding about 8000 cattle on a 35-acre area. That year, Del Webb, a property developer, started to plan a retirement community called Sun City. Webb purchased a large amount of inexpensive farmland, paying considerably less than it would have for property closer to the city. Spur Industries purchased the feedlots in 1960. It expanded the facility to feed up to 30,000 cattle on 114 acres. Webb started selling houses to retirees that year. It continued to develop the property in the direction of Spur’s feedlots. This gradually became a problem, as customers refused to buy houses that were too close to the cattle. Webb sued Spur, claiming that the feeding operation was a public nuisance. The trial court found that the feed pens, with their flies and million daily pounds of manure, were indeed a nuisance to the residents of Sun City. The court issued an injunction ordering Spur to shut down its feedlot. Spur appealed. Want more details on this case?
