Today we are going to talk about the correct way to interdict criminal activity. The old belief is that sitting on a highway with your radar will eventually yield a reasonable seizure. That is a very old-fashioned way of doing police work, and it will not produce the results you want. You have to change the way you look at cars on the road. Look at the car first; what is the car doing? Did the vehicle immediately slam on their brakes when they saw your police car? Did it take evasive action and moved across three lanes of traffic to avoid you? Next, look at the actions of the occupants. Are they avoiding eye contact? Did they immediately light up a cigarette? Are they nervous? Did they switch their seating position and are now driving with both hands on the wheel? Lastly, look at the plate. Whom does the car belong to? Does the current driver match the owner of the vehicle? Is the vehicle a rental? Is the vehicle from a different part of the country? Once you gather all this information and decide that this car may be involved in nefarious activity, you can begin to follow it. If you don't have a violation, this is where you can obtain it. This is a pretextual stop, and it is legal according to Whren v.
