The elements are: the suspect was driving a vehicle, the suspect was under the influence of a mind-altering substances, the suspect's mental faculties were impaired, the suspect's blood alcohol content was over the legal limit if the impairing substance was alcohol, and the suspect contributed to the death in question. In the state of Florida, the legal limit for the blood alcohol content test is .08. In DUI Manslaughter cases, the police will usually take a blood sample instead of a breath sample of the suspect.
