The elements are: the suspect was driving a vehicle, the suspect was under the influence of a mind-altering substances, the suspect's mental faculties were impaired, the suspect's blood alcohol content was over the legal limit if the impairing substance was alcohol, and the suspect contributed to the death in question. In the state of Florida, the legal limit for the blood alcohol content test is .08. In DUI Manslaughter cases, the police will usually take a blood sample instead of a breath sample of the suspect. DUI Manslaughter cases almost always involve a car crash. The individual who dies could be a pedestrian, a person in another car, or a person in the suspect's own car. Ultimately, it is the prosecutor's job to prove that the suspect was indeed the individual behind the wheel. In the state of Florida, prosecutors only need to prove that the person who was driving while impaired contributed to the death of the alleged victim. The legal requirement is low and it is not necessary for prosecutors to prove that the defendant was 100% responsible.
