Administrator of General Services | 433 U.S. 425 (1977) Historically, former presidents were considered to own the presidential materials generated while in office. Legislative efforts to change that practice after President Richard Nixon’s post-Watergate resignation prompted the United States Supreme Court, in Nixon versus Administrator of General Services, to address the proper separation of power between the executive and legislative branches. After Nixon’s resignation, Congress, concerned that Nixon might destroy certain presidential materials, passed the Presidential Recordings and Materials Preservation Act. The act required the Administrator of General Services, an executive-branch official, to take custody of the forty-two million pages of documents and eight hundred eighty tape recordings generated during Nixon’s administration for historical preservation, judicial use, and future public disclosure. The act also required the Administrator to adopt regulations for the materials’ screening by executive-branch archivists to identify personal documents to be returned to Nixon. Nixon sued the Administrator to enjoin the act’s enforcement, alleging, among other things, that the act violated the separation-of-powers doctrine, presidential privilege, and Bill of Attainder Clause. The district court upheld the act as constitutional, and the United States Supreme Court granted review. Want more details on this case?
