[2016] UKSC 11 UKSC 2014/0087 Mr A M Mohamud (in substitution for Mr A Mohamud (deceased)) (Appellant) v WM Morrison Supermarkets Plc (Respondent) On appeal from the Court of Appeal (Civil Division) (England and Wales) This appeal considered the test for vicarious liability of an employer for his employee's violence to a customer. Mr Mohamud stopped at a Morrisons petrol station. Having made an enquiry to a Morrisons staff member, Mr Khan, he was subjected by Mr Khan to an unprovoked and violent assault. Mr Mohamud sued Morrisons, but the Recorder and (on appeal) the Court of Appeal held that Morrisons was not vicariously liable. The Supreme Court unanimously allows the Claimant’s appeal and holds the Respondent vicariously liable for the actions of its employee, in attacking the Claimant.
