In this episode, we discuss a troubling trend we are seeing across the United States: DACA recipients being detained by ICE and denied bond after routine check-ins. Many people assume that immigration court is the place to fight detention. But immigration court is not an independent Article III court. It operates under the executive branch. In certain cases, especially involving DACA recipients or individuals considered subject to mandatory detention, immigration judges may not have the authority to grant bond or terminate proceedings. So what happens when immigration court cannot help? We explain why habeas corpus in federal court may be the only viable strategy in some detention cases. A habeas petition challenges the government’s authority to detain someone without bond and forces judicial review by a federal judge. While this strategy can be effective, it is often expensive and out of reach for many families. We also share updates about our nonprofit initiative, American Immigration Lab, which aims to educate communities and help families prepare in advance in case a loved one is detained.
