Ensuring the existence, location and condition of the property means conducting ocular inspection and documents verification. You need to make sure that you know what you are buying. You need to make sure that the documents are regular and in good order, such as the Original Certificate of Title or Transfer Certificate of Title (or Condominium Certificate of Title for condominium units). The 2nd part is dedicated to the discussion on the documents that you need to have prepared for the purchase of the real property, which include the Deed of Absolute Sale, Acknowledgment Receipt and the Special Power of Attorney. Your_Lawyer also discusses what you need to spell out in the Deed of Absolute Sale, such as the price or consideration, the obligation to pay the capital gains tax, documentary stamp tax, transfer tax and registration fees, the warranties, “as-is, where-is” arrangements, etc. The 3rd part deals with the the step-by-step process in the transfer of the title to the buyer — the documents required and the taxes and fees to be paid.
