On 22 September 2025, the CRL Rights Commission issued a Joint Media Statement claiming it has a mandate to push for legislation to regulate religion in South Africa. But the facts tell a very different story. In this 3-minute video, Michael Swain, Executive Director of Freedom of Religion South Africa (FOR SA), sets the record straight: Parliament’s 2018 COGTA Report rejected the CRL’s proposals. The Speaker of Parliament confirmed the Report has lapsed and has no binding effect. The faith community already developed a Code of Conduct in 2018, grounded in the Religious Freedom Charter adopted by over 20 million South Africans. Since then, SACOFF has united 229 federations, 20,902 churches, and 5 million Christians in voluntary accountability. The 2019 Religious Leaders’ Summit declared state regulation of religion “not an option.” Targeting only one faith sector is discriminatory and breaches Section 9 of the Constitution. South Africa has already had this debate. State regulation of religion is unnecessary, unworkable, unconstitutional – and must be rejected.
