In the departmental proceedings against an employee after the production of evidence, the Inquiring Authority may (a) either hear the Presenting officer and the employee OR (b) may require them to submit their written briefs. As per existing procedure prescribed by Department of Personnel and Training in the year 1978, first the PO should file his brief and only after the copy of it has been given to the employee, he should be required to submit his written brief. However in the year 2003 in the case of Canara Bank and Ors. Vs. Debasis Das the Hon'ble Supreme Court held that there is no such requirement of ' first' the PO submitting his brief. The court held that both the parties i.e PO and the employee have to submit their briefs separately and not one after the other.
