Woman Hits 110 MPH in Wild FHP Pursuit in Charlotte County

Incident Report: On January 12, 2025, I, Trooper Logan Lemen, was actively working as a State Trooper with the Florida Highway Patrol, on duty in Lee County, Florida. I was operating my FHP Dodge Charger patrol vehicle, FHP 1389. My patrol vehicle was prominently marked with the insignia of the Florida Highway Patrol and equipped with a full light bar flashing blue and white lights. It also displayed markings such as "STATE TROOPER" and the seal of the Florida Highway Patrol, with the standard "black and tan" color scheme in continuous use by the Florida Highway Patrol since its formation in 1939. At 1:54 AM, the Florida Highway Patrol Fort Myers Regional Communications Center issued a BOLO for a vehicle that had fled south on US-41 from the Punta Gorda Police Department in Charlotte County, Florida. The vehicle description was a white Ford sedan with Florida license plate RACK76. At the time, I was on SR-82 near US-41 in Lee County, Florida. Upon hearing the BOLO, I headed north on US-41 toward the Charlotte County/Lee County line to locate the vehicle. I positioned myself on US-41 north of Del Prado Blvd, in a location where I could observe southbound traffic and identify license plates. Within minutes, the BOLO vehicle passed my location, traveling at speeds consistent with surrounding traffic. I pulled out of my parking spot and overtook the BOLO vehicle. Upon positioning myself behind it, I confirmed the Florida license plate as RACK76. The vehicle made a right turn onto Del Prado Blvd. I notified the Fort Myers Regional Communications Center that I had located the BOLO vehicle. Shortly after, the vehicle turned left onto De Navarra Pkwy and then left onto Porta Vista Pkwy. As the vehicle made this turn, it entered the wrong side of the road, traveling eastbound in the westbound lanes. At this point, I immediately activated my emergency blue lights in an attempt to conduct a traffic stop. The vehicle entered the parking lot of 3571 Del Prado Blvd, a strip mall containing several businesses. Upon activating my emergency lights, the vehicle began to speed away, traveling behind the closed businesses. It exited the parking lot, turned left onto Dan Leduke Dr, and made an immediate right turn back onto westbound Del Prado Blvd. It was clear the driver was attempting to evade capture. The vehicle failed to stop at stop signs and aggressively accelerated away from my patrol car, despite my emergency lights and siren being activated. I advised the Fort Myers Regional Communications Center that I was in pursuit of the BOLO vehicle as it turned right onto southbound US-41. The pursuit reached speeds of 110 MPH on US-41. As we approached the Shell Factory on US-41, the vehicle made an abrupt U-turn and began speeding northbound. I quickly made a U-turn and reengaged the pursuit. Trooper Hash joined as a backup officer during this time. The pursuit continued northbound on US-41 into Charlotte County, with speeds ranging from 100 to 110 MPH. Upon reaching Notre Dame Blvd, the vehicle slowed and attempted a left turn. Since pursuit speeds were low, there was no surrounding traffic, and the area posed no risk to property, I executed a Precision Immobilization Technique (PIT maneuver), which was unsuccessful. The pursuit continued briefly westbound on Notre Dame Blvd before the driver slowed further. Near a residential neighborhood, given the driver's earlier evasive U-turn, I executed a second PIT maneuver, successfully bringing the vehicle to a stop. Trooper Hash and I exited our patrol cars and issued loud verbal commands for the driver to show her hands and exit the vehicle. She complied and was placed under arrest at 2:17 AM without incident. After the scene was secure, I identified the driver of the BOLO vehicle as the registered owner of the sedan as Yvanka Jael Rivera. An FCIC/NCIC query of Ms. Rivera's license status revealed the following: 08/05/2024: SUSP-INDEF - School election made; failed to attend (ALACHUA CO:53 CT: 1) 06/13/2024: FR-SUSP - Non-judgment suspension (746000941) Florida Authorities Only: Seize FL tag if driver is the owner of the vehicle I ensured Ms. Rivera had not sustained any injuries during the pursuit or PIT maneuvers. She stated she was fine, but Trooper Hash and I had Charlotte County EMS evaluate her as a precaution. EMS staff confirmed she was unharmed. After reading Ms. Rivera her Miranda Rights and confirming she understood them, I asked why she fled. She stated she was scared and trying to call for help. When asked if she had called 911, she admitted she had not and explained she was attempting to contact friends but did not know whom to call. I documented the scene with photographs of both my patrol vehicle and Trooper Hash's vehicle. Once documentation was complete, Prompt Towing took possession of the sedan. I transported Ms. Rivera to the Charlotte County Jail without incident. #policechase #highspeedchase #pitmaneuver
