18-Year-Old Arrested for OWI, Convicted of Second OWI as a 21-Year-Old

FENNIMORE, WI – On June 12th, 2020 at 11:30PM, an officer with the Fennimore Police Department observed a vehicle traveling northbound on Lincoln Ave within city limits. Once the officer positioned himself behind the vehicle, the car quickly turned into a gas station and two female occupants ran inside the gas station. The officer eventually approached the passenger and spoke with the suspect. The officer then claimed due to the smell of an alcoholic beverage coming from inside the vehicle that he would need to obtain a preliminary breath test due to both the suspect and passenger being under the age of 21. The passenger submitted a preliminary breath alcohol sample of .025% which is above the zero tolerance limit in Wisconsin. Once the officer began speaking with the suspect, she claimed that she had six alcoholic beverages earlier in the evening. The officer would later ask the suspect to step out of her vehicle to a perform field sobriety test to which she complied. During the horizontal gaze nystagmus test, the suspect displayed a lack of smooth pursuit and distinct and sustained jerkiness at maximum deviation in both eyes. For the walk-and-turn test, the suspect started the test early and had to be told to remain in the starting position as instructed. The suspect then made an improper turn, raised her arms for balance, took 10 total steps on the last series of steps, and stepped off line on step eight in her first series of steps. During the one leg stand test, the suspect swayed while balancing, hopped on one foot, raised her arms for balance, and set her foot down at one point. The suspect then provided a preliminary breath alcohol test which yielded a result of .094% and was subsequently arrested. The suspect was then transported to the Grant Regional Health Center whereupon she agreed to providing an evidentiary sample of her blood and was charged with operating while intoxicated, or OWI. More than two years later on October 28th, 2022, the suspect was transported to the Vernon Memorial Hospital after crashing her vehicle in Clayton, WI. During the investigation, the suspect admitted to drinking earlier in the evening and driving the vehicle. The suspect would eventually agree to providing an evidentiary blood test for the second time and was charged with OWI – second offense.
