Can entrepreneurs sponsor their own H-1B visa? In this success story, we share a real case where a startup founder obtained an H-1B through his own company under the new H-1B entrepreneur rule. Our client was a business development specialist with an MBA who had years of experience working with large companies in the hospitality industry. He decided to start his own business development consulting firm and wanted to continue working in the U.S. by applying for an H-1B through his own startup. With the recent H-1B regulation changes, beneficiary-owned companies can now sponsor founders and entrepreneurs, but these cases require careful planning and strong documentation. In this case, we helped structure the company, prepare a detailed business plan, and demonstrate that the role qualified as a specialty occupation under the H-1B rules. Some of the key issues we had to address included: • How to structure an H-1B self-petition through a startup company • Proving the role qualifies as a specialty occupation tied to the applicant’s degree • Showing the company has the ability to pay the H-1B prevailing wage • Creating a strong business plan with hiring projections and financial forecasts • Establishing a bona fide employer-employee relationship, even though the beneficiary owned the company • Demonstrating a physical office location for the Labor Condition Application (LCA) • Preparing the case quickly due to the applicant’s expiring I-94 status To address the employer-employee relationship issue, the company created a corporate governance structure with an LLC manager and board oversight, ensuring that someone other than the founder had authority to supervise, hire, and terminate employees. The case was approved without pushback on the investment documentation, showing that entrepreneurs can successfully pursue H-1B visas through their own startups when the case is structured properly.
