It eliminates the timing restrictions found in normal expungement, being the three or 10 year wait period. And it limits the DA’s time to object to 30 days. This means the DA can’t hold you in purgatory as they do in normal expungements. Now, in order to qualify, you must have a qualifying marijuana conviction. This includes PCS of less than an ounce, possession of no more than eight ounces, delivery of less than an ounce, manufacturer of no more than four plants. There are also many other convictions that qualify for possession, delivery, and manufacturer of cannabis, cannabis concentrates, and cannabis extracts.
