ATLANTA — Tuesday, February 3, 2026 — Families from across Georgia gathered at the Georgia Supreme Court Tuesday afternoon to speak against applying an arbitrary limit or cap on what can be awarded in cases where people are injured or killed due to medical negligence and to advocate for the long-standing right to have juries determine damages. The Georgia Supreme Court will hear oral arguments in two closely watched cases that could determine whether lawmakers may impose a $350,000 cap on damages for medical malpractice, including wrongful death cases. Following the hearing, Voices of Families for Justice held a press conference on the steps of the Georgia Supreme Court, featuring families who have suffered devastating losses from medical malpractice. These are families whose lives were permanently and irreparably changed by a negligent healthcare system. A $350,000 damage cap will protect healthcare corporations for negligently killing or severely harming people, especially the most vulnerable. These caps would allow for billion-dollar medical and insurance companies to easily budget for negligent deaths and injuries as a cost of doing business, increasing risk for all patients across the system. At the heart of the hearing is a fundamental question: Should healthcare systems in Georgia be shielded from responsibility for the harm they cause innocent patients and families? That is what a $350,000 cap on damages will do. For generations, access to civil justice has been one of the most effective ways for Georgia families to hold negligent healthcare systems accountable, uncover dangerous practices, expose repeat harm, and prevent future tragedies. These cases create a public record that helps protect patients and communities. The Supreme Court’s decision will determine whether families harmed by healthcare system negligence will retain a meaningful path to accountability, or whether politicians will pre-decide and limit the value of their losses at $350,000 before a jury has the chance to consider the evidence.
