Misrepresentation under Section 40 of the Immigration and Refugee Protection Act (IRPA) is a serious ground for inadmissibility to Canada, applying to both permanent residents and foreign nationals. The law is intentionally broad and strict, aiming to maintain the integrity of Canada’s immigration system. Definition and Scope Section 40(1) states that a person is inadmissible for misrepresentation if they: Directly or indirectly misrepresent or withhold material facts relating to a relevant matter that induces or could induce an error in the administration of the Act. Are or have been sponsored by someone found inadmissible for misrepresentation. Are subject to a final determination vacating a refugee or protection decision, or have ceased to be a citizen under certain circumstances. Material facts are those that are relevant and significant to the processing of an immigration application. Misrepresentation can include: Providing false statements (incorrect information, whether intentional or not) Submitting forged or fraudulent documents Withholding or omitting key information (such as previous refusals, criminal history, or family relationships) Even errors or omissions made by representatives (e.g., immigration consultants) can result in a finding of misrepresentation, and the applicant is still held responsible.
