The issue of University Grants Commission (UGC) Regulation 2026 has reached the highest court of the country, with the Supreme Court of India taking a strong stand during the recent hearing. In the hearing held on 19 March, the Supreme Court made it clear that the UGC Regulation 2026 will remain in abeyance (on hold) for now. The Court has allowed the continuation of the 2012 regulations, stating that the new rules cannot be implemented until proper constitutional clarity is established. One of the most controversial aspects of the new regulations is Clause 3(c), which deals with the definition of caste-based discrimination. Petitioners argued that the clause seems to focus only on SC, ST, and OBC categories, leaving the general category students without adequate protection. The Court observed that the language of the rule appears “unclear” and could potentially lead to misuse or discrimination within campuses. Concern was also raised about the risk of creating division instead of promoting inclusivity in educational institutions. Justice B.R. Gavai and Justice J.B. Pardiwala (bench discussion context) emphasized the need for clarity in the legal language, while the Court suggested forming an expert committee to review and refine the rules. The Supreme Court also warned against the possibility of “segregation” within campuses and stressed that education institutions must remain inclusive spaces for all students.
