This episode of NDN POV explores the complex history of the Indian Act, a colonial piece of legislation that has hampered the relationship between the federal government and First Nations. The Indian Act, enacted in 1867s, remains a powerful tool of colonial control over First Nation lands and peoples. The Act consolidated various colonial statutes into a single, overarching law enforcing European values, and negatively impacting every aspect of First Nation life. Despite the many amendments to the Act since 1867, the Act continues to hinder First Nations' rights to self-determination over their citizenship, law-making, economic activities, and governing systems. The Indian Act did not, however, require the federal government to make policy decisions to address chronically underfunded essential services like housing, child welfare, and water infrastructure, which continue to perpetuate systemic inequalities. Despite the exercise of paternalistic control over First Nations by the federal government through the Indian Act, First Nations have continually fought to assert their rights and preserve their cultures. It is one of the reasons why many First Nations fought to prevent the federal government from unilaterally repealing the Indian Act, without first providing solid legal protections for First Nation rights. While some advocate for repealing the Indian Act today, it’s crucial that this process is done with the free, prior, and informed consent of First Nations. However, the call for reconciliation, requires more than government action related to the Indian Act, it requires the involvement of all Canadians to advocate for an end to racism and injustice against First Nations.
