Three people were sentenced Wednesday morning in the case of 10-year-old Takoda Collins' death. Takoda's father, Al Mutahan McLean, had pleaded guilty to murder, rape and other charges earlier this month. He was sentenced this morning to 51 years to life in prison. Adkins says this was the most horrific case of abuse and torture the court has seen. "Although you admit what you did, I do not believe that you fully understand the depravity of your actions in torturing this innocent child," Judge Adkins said. He says in McLean’s favor, he admitted guilt in the death of his son, and has a limited criminal history. Judge Adkins says McLean, 32, will be required to enroll as a Tier III sex offender and as a violent offender. McLean's girlfriend Amanda Hinze was then sentenced to 22 to 27.5 years in prison. "If I could trade my life for his, I would," Hinze said today in court. "You are to blame in this case, you could have stopped this," Judge Adkins said. We talked one-on-one with Hinze's Attorney Dennis Lieberman after sentencing. He says the sentence was a compromise. He says in talking with Hinze he does believe she shows remorse, knowing she could have saved Takoda's life. "That weighs heavily on her and she will live in her own hell while she serves her term in prison and after she gets out," Lieberman said. Hinze and her sister Jennifer Ebert had pleaded guilty to involuntary manslaughter and multiple counts of child endangering in this case. Ebert was sentenced to 8 years in prison for her role. "What you did is pure evil," Judge Adkins said. "You provided no mercy to your son and deserve no mercy from this court." Takoda's grandma was at the sentencing hearings, but she would not go on camera. In a letter read by a victim advocate in court, she did ask for justice. Judge Adkins also acknowledged that other agencies failed Takoda in this case as well. He specifically called out Dayton Public Schools. Takoda was a student at Horrace Mann Elementary, but his father pulled him out of school in 2018 to be homeschooled. "I wonder what if the administrators at Dayton Public School system had pushed this issue whether or not there would have been further action," Judge Adkins said. Dayton Public Schools Superintendent Dr. Elizabeth Lolli previously said teachers called children services 17 times to report abuse concerns. "I don't blame the teachers at all they did what they could but people in authority and administration of protecting our children should do more," Judge Adkins said. DPS said it had no comment on Judge Adkins statement. Judge Adkins also called out Montgomery County Children Services. "Children services just absolutely dropped the ball on this case, they were told what was going on and what was suspected of going on and they really just went through the motions to check on the welfare of Takoda," Judge Adkins said. "They were very good at passing the buck." “Takoda Collins’ death was felt deeply by our entire community, to include Montgomery County Children Services," said Danielle Damon, Public Information Officer for Montgomery County Human Services. She said they work with community partners to "strike the proper balance between parental rights and child protection." She says ODJFS and the Governor's Office of Children Services Transformations has the ultimate overside for the Child Welfare System. She says they also have increased staff training. "It cannot be overstated, the death of Takoda was tragic and our thoughts remain with his extended family," Damon said. "We hope today’s sentencing brings some peace during this painful time." Prosecutor Mat Heck spoke after the sentencing, he says they are also now working with local agencies to be sure they better communicate to protect victims of child abuse. "I think the time for finger pointing is over with and I think right now we have to be proactive and be positive and say what can we do to better the system so something like this never ever happens again," Prosecutor Heck said.
