Canada Immigration Lawyer Explains: In Canadian immigration law, resettlement applications, refugee status determinations, and inadmissibility assessments are closely linked but operate at different stages of protection and entry. A resettlement application is usually made abroad by individuals recognized as refugees by international bodies or foreign states, or who are referred to Canada through programs like the UNHCR or private sponsorship. Immigration officers assess whether the applicant meets the definition of a refugee and whether they are eligible for resettlement in Canada. Refugee status is determined inside Canada when a person makes a claim at a port of entry or inland. The Immigration and Refugee Board (IRB) decides if the claimant meets the legal definition of a Convention refugee or a person in need of protection. This is a rights-based process focused on risk of persecution or harm in the country of origin. #FederalCourt #Canada #ImmigrationLaw #RefugeeStatus #Resettlement #Inadmissibility #RefugeeLaw #JudicialReview #JudicialReviewCanada #FederalCourtChallenge #ImmigrationLitigation #VisaRefusalAppeal #CanadaLegalRights Simranjeet Singh Sidhu Barrister and Solicitor Law Society of Ontario, Canada +1-807-697-5151
