Tom recommends a minimum of $1 million in coverage, more if you have a large book of business. If you are a hosted advisor, get your own policy on top of your host agency's coverage. Terms & Conditions A generic template will not cut it. Your T&Cs need to be customized to your business and should include legally required disclosures, a clear description of your role as an agent, cancellation and refund policies, limitations on liability, and force majeure clauses. Most importantly, your clients need to actually agree to them. Client Agreements Tom recommends using a separate client agreement form that captures your client's consent to your T&Cs, your fees, and your insurance recommendations. Keep the workflow simple and linear so nothing gets skipped. Credit Card Authorizations Credit card companies now require agencies to disclose cancellation and refund policies at the point of charge and get explicit authorization for them. Each authorization should include the date, amount, supplier, and product. Technology Tools Tom highlights how tools like Tern can help streamline client agreements, credit card authorizations, and compliance workflows, reducing manual steps and human error.
