Any of the following actions by lenders, NBFCs, digital apps, or recovery agents may be considered harassment: Threatening calls, abusive language Calling family, friends, or employer Public shaming through WhatsApp groups or social media Fake legal notices / threats of arrest Repeated calls at odd hours Physical intimidation or visiting home/workplace without permission These actions violate RBI guidelines, IT Act, and Indian Penal Code sections regarding criminal intimidation, defamation, and extortion. 2. What RBI Rules Say For banks and NBFCs, RBI mandates: Recovery agents must behave professionally, politely, and respectfully No calls before 8 AM or after 7 PM No contact with anyone other than the borrower unless the borrower has given consent No harassment, misrepresentation, or threats Digital lending apps must disclose their registered NBFC partner, interest rates, recovery process, etc. If these rules are violated, you can file a complaint. 3. What you should do if you’re being harassed Step 1: Collect evidence Save: Call recordings Screenshots of messages Threats / fake notices Caller numbers This will help in legal action. Step 2: Complain to the lender Every regulated lender has a Grievance Redressal Officer (GRO). Send a written complaint via email or WhatsApp and ask for acknowledgment. Step 3: Escalate to RBI If the lender does nothing within 30 days, file a complaint on: ⬩ RBI CMS portal: https://cms.rbi.org.in ⬩ Or email the NBFC/BANK nodal officer Step 4: File a police complaint You can file an FIR for offences such as: Section 503/506 IPC – Criminal intimidation Section 384 IPC – Extortion Section 499/500 IPC – Defamation Section 66A / IT Act sections (applicable parts) – Online harassment If the police refuse, you can approach the SP or file a complaint under Section 156(3) CrPC in court. Step 5: Complain to MEITY (for digital app harassment) Report illegal apps or misuse of personal data at: support-meity@gov.in or grievance officer of Google Play Store app listing. 4. If the lender is an unregulated illegal instant loan app Many apps on social media or APK files are not registered NBFCs. They: Steal phone contacts Create fake legal threats Send morphed images Charge 200–500% interest In such cases: Do NOT pay again; it may make harassment worse File a police cyber complaint: https://cybercrime.gov.in Block numbers and preserve evidence 5.
